Welcome to DiMaker (Sole Proprietor Berezhnoi Artem Gennadievich, registered in the Russian Federation, TIN 381705867957, hereinafter referred to as “DiMaker” or “we”)!

This page explains the terms under which you can use our online and mobile services, website, and software provided in connection with the service (collectively referred to as “DiMaker”). By accessing or using DiMaker, you agree to comply with these Terms of Use (“Terms”), whether or not you are a registered user. These Terms apply to all visitors, users, participants, and others who access DiMaker (“Users”).

1. Use of DiMaker

You may use DiMaker only if you are able to form a binding contract with us and only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations. You must be at least 13 years old to use or access the Service unless your use of the Service is directly supervised by a parent, guardian, or another authorized adult (e.g., a teacher) who agrees to be bound by these Terms. Any use or access to DiMaker by individuals under the age of 13 without direct adult supervision is strictly prohibited and constitutes a violation of these Terms.

2. Status, Terms, and Acceptance of These Terms

This User Agreement is a legally binding contract between the User and us, governing the provision of services related to the use of DiMaker’s features.

In addition to this Agreement, specific rules for using DiMaker’s services may be outlined in additional documents specific to certain services. Users must fully review these Terms before using DiMaker.

We may update these Terms unilaterally without special notice to Users, provided that the updated Terms are made publicly available for Users’ review. Continued use of DiMaker after changes to these Terms indicates the User’s acceptance and unconditional agreement with such changes.

3. Registration and Authorization in DiMaker

Registering with DiMaker is a voluntary act. Users are responsible for ensuring the accuracy, validity, completeness, and compliance with the applicable laws of the Russian Federation of the information provided during registration. Users must not share their login and password with third parties and are fully responsible for their safekeeping.

All actions carried out using the User's login and password are deemed to have been performed by the respective User unless proven otherwise in accordance with established procedures. In the event of a compromised login and/or password or unauthorized access to the User’s personal account, Users must notify us immediately.

4. User Rights and Obligations

Users have the right to:

  • Use DiMaker for personal, non-commercial, and commercial purposes (unless stated otherwise) to the extent the features are available to them.
  • Use DiMaker’s functionality in good faith.

Users are obligated to:

  • Comply with the provisions of these Terms and any other specific documents published on this website.
  • Refrain from using any information or materials (including links) that may violate the rights of others.
  • Regularly review these Terms and monitor any modifications.

5. Restrictions on Using DiMaker

When using DiMaker’s functionality, Users are prohibited from:

  • Uploading, publishing, storing, reproducing, processing, distributing, or otherwise using any intellectual property without prior written permission from the rights holders.
  • Promoting social, racial, national, or religious hatred or conflict, advocating war, or promoting social, racial, national, or religious superiority.
  • Engaging in actions aimed at destabilizing the functionality of DiMaker or attempting unauthorized access to its management.
  • Publishing materials in DiMaker that contain threats or could harm the honor, dignity, or business reputation of individuals or organizations.
  • Unauthorized access to other Users’ accounts through password guessing or other means, as well as distributing viruses or malicious programs.
  • Uploading, publishing, storing, or otherwise using information that:
    • Is obscene, contains pornographic imagery/text, or involves minors in sexual contexts.
    • Includes offensive or abusive language.
    • Depicts animal abuse.
    • Promotes suicide methods or incites acts of suicide.
    • Contains extremist content or advocates for fascism.
    • Encourages criminal activity or provides instructions for committing crimes.
    • Depicts narcotic use positively or provides information on their manufacture/distribution.
    • Contains confidential information, including state, commercial, or family secrets.
    • Is fraudulent in nature.
    • Violates the rights and interests of others.

6. Personal Data

The processing of User personal data is governed by applicable laws of the Russian Federation.

We process Users' personal data to fulfill this Agreement and provide services. We take all necessary measures to protect User data. We reserve the right to disclose personal data only as required by law (including to prevent unlawful actions). We may send Users information about DiMaker updates or advertise our services.

7. Limitation of Liability

We are not responsible for potential failures or interruptions of DiMaker and any resulting data loss. DiMaker is provided "as is," and we make no guarantees regarding its suitability for specific purposes.

We are not liable for damage to a User’s devices caused by using DiMaker. Password breaches leading to unauthorized account access or any resulting damages are not our responsibility. Users are fully liable for illegal actions taken through their accounts or any content published via DiMaker.

8. Intellectual Property

Users must not upload content in DiMaker for which they lack exclusive rights unless consent is obtained from the rights owner. Uploaded content is not subject to prior moderation or review by us.

These Terms do not grant Users the right to use trademarks, domain names, or any other distinctive marks owned by us. Such rights can only be granted through a written agreement with us.

9. Final Provisions

These Terms are written in Russian and may be translated into other languages at our discretion. In the event of discrepancies between versions, the Russian version takes precedence.

The invalidity of any provision of these Terms as determined by a court does not affect the validity of the remaining provisions.

If any Terms are violated, DiMaker reserves the right to suspend access, terminate the account, and revoke licenses.

All disputes must first be resolved through negotiations, adhering to a mandatory pre-trial claim process. If no resolution is reached within 90 days (accounting for mail delivery), the matter will be referred to court in the jurisdiction where the administration is located.
